Terms & Conditions

This Agreement sets forth the terms and conditions governing your use of www.interafricageospatial.com (the Site) and the services offered.
The Site is operated by InterAfrica Geospatial LTD (InterAfrica Geospatial), a Geographic Information Systems (GIS)-Earth Observation Sciences and Technology services firm. Your access to and use of the Site is conditional on your acceptance of these Terms without modification. By using the Site, you agree to be bound by these Terms and to comply with all applicable laws and regulations.
InterAfrica Geospatial is committed to providing reliable geospatial solutions efficiently and economically. 
Your use of the Site is subject to InterAfrica Geospatial's Privacy Policy.

Payment Policy

For all projects, InterAfrica Geospatial requires a 50% upfront payment before work commences. The remaining 50% is due upon project completion and before the delivery of final products or services. For projects exceeding $5,000, we may offer a milestone-based payment schedule, which will be outlined in the project proposal.

Cancellation/Refund Policy

If you need to cancel an order, you may do so before the project commences, and we will refund the full amount of any upfront payment. For cancellations after work has begun, refunds will be prorated based on the work completed. Please note that cancellations for custom software development or data acquisition projects may be subject to additional fees.

GIS and Geospatial Solutions Policy
  1. Data Accuracy: While we strive for the highest level of accuracy in our geospatial data and analyses, you acknowledge that some degree of error is inherent in geospatial information. We provide our services on an "as-is" basis and do not warrant that the information will be error-free.
  2. Data Ownership: Unless explicitly stated otherwise in a separate agreement, InterAfrica Geospatial retains ownership of all raw data, methodologies, and proprietary algorithms used in our geospatial solutions. Clients receive a license to use the final products for their intended purpose.
  3. Data Security: We implement industry-standard security measures to protect geospatial data. However, you are responsible for maintaining the confidentiality of any login credentials and for restricting access to your account.
  4. Third-Party Data: When incorporating third-party data into our solutions, we adhere to all applicable licensing agreements. You agree to comply with any usage restrictions associated with such third-party data.
  5. Software Licensing: Any software provided as part of our geospatial solutions is licensed, not sold. The terms of the license will be provided with the software or in a separate licensing agreement.
  6. Updates and Maintenance: For ongoing GIS projects or hosted solutions, we will provide regular updates and maintenance as specified in the service agreement. Additional fees may apply for major updates or customizations.
  7. Training and Support: Initial training on delivered GIS solutions is included in the project cost. Ongoing support and additional training may be available for an extra fee.
  8. Compliance with Local Regulations: You are responsible for ensuring that your use of our geospatial products and services complies with all applicable local, national, and international regulations governing geospatial data and technology.
Intellectual Property

All content included as part of the Service is the property of InterAfrica Geospatial or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.

Indemnification

You agree to indemnify, defend and hold harmless Interafrica Geospatial, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses relating to or arising out of your use of or inability to use the Site or services, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations.

Arbitration

In the event of any dispute arising out of or relating to these Terms and Conditions, the parties agree to resolve the dispute through final and binding arbitration, conducted by a single neutral arbitrator and administered by an arbitration body recognized in Africa, such as the Arbitration Foundation of Southern Africa (AFSA) or any other Bodies.

Class Action Waiver

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted.

Changes to Terms

InterAfrica Geospatial reserves the right to modify these Terms & Conditions at any time. We will notify users of any significant changes by posting a notice on our website or sending an email to the address associated with your account.

By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.
